Two: Introduction of Trademark Search

A trademark search is a study of the registered marks or logos from the government database, to make sure the marks or logos we have designed are distinguishable from the registered ones, and free from infringement. A trademark search, while optional, should not be underestimated in terms of its value to your business. It is important to know the full extent of any possible use of your mark prior to filing a trademark application. It is not uncommon that some third party has already registered your mark or has rights to use the mark that you wish to register. Additionally, assuming the trademark search reflects that your mark is already registered, investing in a search for the mark you want will have saved you both the trademark application preparation fee as well as the trademark filing fees.

There are a variety of trademark searches available. Unless otherwise specified, each search takes approximately three (3) business days to complete. However, these searches can be also expedited for an additional charge. A word of caution, at any given time the information in any of the various searchable databases can be as much as one (1) month old and sometimes more. Here is a quick summary of the available searches:

Logo/Design and Preliminary Search. This search is specifically for the logo and design elements of the logo or design. It does NOT include a trademark search for any words included in the logo or design.

This trademark search is best described as a "preliminary screening search" of the U.S. Federal database and covers up to five (5) different names. It is an "exact match" search of the Federal database only and as such it does not search for similar marks, marks with fanciful spellings or foreign language trademarks or translations.

Hong Kong Private Search + Domains [$100.00]. This search includes the Tannet limited  databases. This is fairly comprehensive and will provide you with an excellent trademark search product in a timely fashion.

Hong Kong Government Search [$200.00]. This is our most comprehensive trademark search and is the search we always recommend. It includes the Federal, state, Domain Name and expanded common law databases, which includes, Dun and Bradstreet, Brands and Their Companies, Thomas Register, Library of Congress, News File, Domain Names and Digital Common Law - Internet Content.
China Basic Comprehensive Search [$50.00]. This search includes the Federal, State and limited common law databases. The "limited common law" database includes the "Dun and Bradstreet" and "Brands and Their Companies" databases only. This is fairly comprehensive and will provide you with an excellent trademark search product in a timely fashion.

China Full Comprehensive + Domains [$100.00]. This is our most comprehensive trademark search and is the search we always recommend. It includes the Federal, state, Domain Name and expanded common law databases, which includes, Dun and Bradstreet, Brands and Their Companies, Thomas Register, Library of Congress, News File, Domain Names and Digital Common Law - Internet Content.
U.S. Basic Comprehensive Search [$400.00]. This search includes the Federal, State and limited common law databases. The "limited common law" database includes the "Dun and Bradstreet" and "Brands and Their Companies" databases only. This is fairly comprehensive and will provide you with an excellent trademark search product in a timely fashion.

U.S. Full Comprehensive + Domains [$540.00]. This is our most comprehensive trademark search and is the search we always recommend. It includes the Federal, state, Domain Name and expanded common law databases, which includes, Dun and Bradstreet, Brands and Their Companies, Thomas Register, Library of Congress, News File, Domain Names and Digital Common Law - Internet Content.

Four:The Concept of Infringement

Trademark infringement is a violation of the exclusive rights attaching to a trademark without the authorization of the trademark owner or any licensees (provided that such authorization was within the scope of the license). Infringement may occur when one party, the "infringer", uses a trademark which is identical or confusingly similar to a trademark owned by another party, in relation to products or services which are identical or similar to the products or services which the registration covers. An owner of a trademark may commence legal proceedings against a party which infringes its registration.
